1. Agreement to Terms

By accessing any website, store, or service operated by Adlai Dyson | Fused Frame Photography, you agree to these Terms. If you do not agree, you must discontinue use immediately.

2. Scope

These Terms apply to all domains, subdomains, and services operated by me (including but not limited to fusedframe.co.uk, adlaidyson.co.uk, adffp.uk, shuttersociety.uk, exifoverlay.com, and upperhaughweather.uk), encompassing portfolio sites, e-commerce stores, tools, APIs, and hosted platforms.

3. Store Purchases & E-Commerce

a) Digital Photo Files

  • Due to the nature of digital goods, all sales of digital files are final.

  • Under the UK Consumer Contracts Regulations, by downloading a digital file immediately upon purchase, you acknowledge that you lose your standard 14-day right to cancel.

  • If you experience a technical issue with your digital download, please contact me for assistance.

b) Fine Art Prints (Physical Goods)

  • Physical prints are fulfilled via a print-on-demand service (Photo Clever via Printify). Because these items are custom-printed specifically for your order, they are exempt from standard "change of mind" returns under UK law.

  • Damaged or Defective Items: If your print arrives damaged or has a manufacturing defect, please contact me at hello@fusedframe.co.uk within 14 days of delivery, including photographic evidence of the damage, so I can arrange a free replacement or refund.

c) Payments All payments are processed securely via Wix Payments. I reserve the right to refuse or cancel any order if fraud or an unauthorised transaction is suspected.

4. Intellectual Property

All content is strictly protected under UK copyright law. This includes photographs, text, graphics, code, metadata, tools, and software. You may not copy, reproduce, modify, or distribute any content without my prior written permission. (Please see my Copyright & Licensing Notice for full details).

5. Acceptable Use

You agree not to:

  • Attempt unauthorised access to systems or bypass security measures.

  • Interfere with services or infrastructure.

  • Abuse tools (e.g., automated misuse, scraping).

  • Upload malicious or illegal content to any hosted platform.

6. Tools, Services & API Disclaimer

Tools (e.g., EXIF Overlay, weather services) and APIs are provided "As is" without any guarantee of accuracy, uptime, or availability. Automated scraping of APIs is prohibited, and access may be restricted or revoked at any time. I am not liable for data inaccuracies, output errors, or service interruptions.

7. Third-Party Services

My websites utilise third-party services (e.g., Wix, Printify, YouTube). I am not responsible for their content, uptime, or individual service policies.

8. Limitation of Liability

To the fullest extent permitted by law, I am not liable for any indirect or consequential damages, loss of data, loss of profits, or service downtime arising from your use of my websites or services.

9. Termination

I reserve the right to restrict access, block users, or remove content without notice if these terms are violated.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be handled exclusively in the courts of the United Kingdom.
